SO ON THE AGENDA TONIGHT, THE ONLY THING ON THE AGENDA IS THE REFERRAL FROM TOWN COUNCIL CONSIDERATION OF RESOLUTION 13 DASH 2026, CONSIDERATION OF ORDINANCE 2026 DASH 12, REPEALING AND REPLACING THE AFFORDABLE HOUSING PROVISION WITH THE AFFORDABLE HOUSING SECTION SIX 13, RIGHT? CORRECT.SO WHERE DO WE GO FROM HERE? WE JUST MOTION I CAN SAY SOMETHING
SO, UH, ACCORDING TO THE COURT ORDER, UM, THIS, UH, ORDINANCE HAS TO BE PASSED BY, UH, MAY 13TH.
SO FIRST READING WAS LAST NIGHT WITH COUNSEL REFERRED TO THE CLAIM BOARD TODAY, AND THEN SECOND READING WILL BE ON THE 12TH BY COUNSEL AND SUBMITTED TO, UH, THE COURT IN, UH, ACCORDANCE WITH THAT COURT ORDER.
THIS REPLACES THE OLD ORDINANCE, WHICH WAS THE PREVIOUS REGULATION.
SO THIS SETS FORTH REGULATIONS FOR MODERATE INCOME HOUSING IN, UH, INCLUDING THE AMENDED FAIR, FAIR HOUSING ACT, AS WELL AS THE DCA DEPARTMENT OF COMMUNITY AFFAIRS.
UH, UH, STATUTORY UPHELD, REG EXISTING REGULATIONS.
AND THOSE ARE THE NOW DEFUNCT COUNCIL ON AFFORDABLE HOUSING, WHICH IS CO-OP AND IT CREATES CONTROLS ON AFFORDABILITY OVER TIME FOR AFFORDABLE UNITS.
AND THE ORDINANCE INCLUDES, APPLIES TO LAW, INCLUSIONARY DEVELOPMENTS, INDIVIDUAL, INDIVIDUAL AFFORDABLE UNITS, AND A HUNDRED PERCENT AFFORDABLE HOUSING DEVELOPMENT UNITS.
IT'S A LOT OF TECHNICALITIES TECHNICAL, UH, REGULATIONS AND JUST SETS FORTH WHAT WE HAVE TO FOLLOW, WHICH WE HAVE BEEN FOLLOWING.

AND, UH, YESTERDAY WE RECEIVED A CERTIFIED LETTER IN THE MAIL FROM DU BOIS AND ASSOCIATES REGARDING A, A PROJECT THAT WHEN I, AND I THINK WE RECEIVED IT BECAUSE ALL OWNERS OF REAL PROPERTY WITHIN 200 FEET OF THIS PROPOSED DEVELOPMENT RECEIVED THESE DOCUMENTS.

WHEN I LOOK AT THE MAP, TO ME IT LOOKS LIKE THIS PROJECT WILL REPLACE THE FLYING W AIRPORT.AND I THOUGHT THAT WE GOT IT BECAUSE I'M THINKING THE BOUNDARIES, THE CREEK.
AND THAT WOULD EXPLAIN WHY WE RECEIVED THE, THE, UM, THE, THE LETTER.
SO I WANTED TO JUST MAKE SURE THAT I UNDERSTOOD, UH, WHAT WAS HAPPENING.
AND THEY GIVE QUITE A DESCRIPTION OF THE, THE PROJECT, UH, APPEARS.

THIS IS AN APPLICATION, UH, THAT THE, THEY'RE SENDING TO THE STATE FOR FLYING W FOR WETLANDS, FRESHWATER WETLANDS, GENERAL PERMITS, TRANSITION AREA, WAIVER AVERAGING PLAN, AND FLOOD HAZARD INDIVIDUAL PERMIT.
SO WHEN THEY SUBMIT IT TO THE STATE, THEY HAVE TO NOTIFY, NOTIFY ALL PROPERTY OWNERS FOR THE 200 FEET.
THAT, THAT IS 200 FEET BECAUSE OF THE CREEK, WE, WE BACK UP CREEKS.
I MEAN THE FOOT OF THE FOOTAGE OF THE CREEK COUNT.
SO IF YOU BACK UP TO THE CREEK, YOU'RE PROBABLY RIGHT NEXT TO IT THEN.

SO THE STATE HAS TO REVIEW IT AND THEN APPROVE IT, AND THEN IT ALSO HAS TO COME IN FRONT OF THE PLANNING BOARD FOR A SUBDIVISION SITE PLAN APPROVAL.
AND THAT HAS, THAT HAS NOT HAPPENED YET.
YOU'LL ALSO GET NOTIFIED OF THAT WHEN IT GETS SUBMITTED TO THE PLANNING BOARD.
THIS DESCRIBES QUITE A, A COMPLEX SINGLE FAMILY HOMES, UM, 55 AND OVER SENIORS AFFORDABLE HOUSING.
IS IS THAT, IS THAT THE ACTUAL PROPOSAL TO HAVE THAT? YES, THAT'S PART OF OUR FOURTH ROUND HOUSING PLAN.
AND THAT'S CONCEPT PLAN YOU HAVE IN THE BACK THAT'S ON THAT SECOND PAGE? YEAH.
THAT'S WHAT'S IN THE HOUSING PLAN.
SO THAT'S ESSENTIALLY WHAT IT'S GONNA LOOK LIKE.
IT'S A CONCEPT PLAN, SO IT COULD CHANGE MM-HMM
IT'S GONNA PRETTY MUCH LOOK LIKE THAT.
AND SAYS 246 FEE, SIMPLE MARKET RATE, ACTIVE ADULT SINGLE FAMILY UNITS.

I GUESS JUST ONE OTHER QUESTION WOULD BE, UH, HOW WOULD THE WATER AND SEWER BE PROVIDED TO A, A NEIGHBORHOOD OF THIS MAGNITUDE? THE SEWER'S GONNA BE, IS GONNA COME FROM MEDFORD AND THE WATER WILL ALSO COME FROM MEDFORD.
