SO, UH, WE ARE HERE TONIGHT TO REQUEST THREE ONE YEAR EXTENSIONS OF OUR PRELIMINARY AND FINAL MINOR SITE PLAN APPROVAL, WHICH THIS BOARD GRANTED BY WAY OF UNANIMOUS VOTE ADOPTED IN FEBRUARY, 2024.

AS THE BOARD KNOWS, WE ARE ENTITLED TO REQUEST A MAXIMUM OF THREE ONE YEAR EXTENSIONS PURSUANT TO LAW SPECIFICALLY IF WE WANNA GET BORING ABOUT IT.

NJSA 40 55 D DASH 52 A AND EXTENSIONS UNDER SUBSECTION A ARE DISCRETIONARY TO THE BOARD, BUT GENERALLY ARE LIBERALLY GRANTED.

SO LONG AS THERE HAVE BEEN NO MAJOR ZONING CHANGES AND THE APPLICANT CAN GIVE A JUSTIFICATION FOR THE DELAY HERE.

THE ZONING FOR THE PROPERTY HAS NOT CHANGED, THE PROJECT REMAINS VIABLE AND THE APPLICANT IS PROCEEDING DILIGENTLY FOR OUTSIDE APPROVALS.

WE ARE CURRENTLY STILL NAVIGATING THE APPROVALS PROCESS FROM THE PINELANDS AND THE DOT.

UH, WE RECEIVED A LETTER AS RECENTLY AS THIS MORNING FROM OUR ENVIRONMENTAL CONSULTANTS INFORMING US THAT PINELANDS REVIEW REMAINS ONGOING, BUT THAT PINELANDS HAS NOT MADE ANY ADDITIONAL REQUESTS FOR DOCUMENTS, WHICH WE BELIEVE IS A POSITIVE SIGN.

UH, SO TO REITERATE, THE APPLICANT IS A SMALL BUSINESS OWNER WHO IS DILIGENTLY WORKING TO PROPERLY GET APPROVALS FROM THE PINELANDS, THE DOT OUT OF CAUTION, WE ARE REQUESTING THE MAXIMUM EXTENSIONS JUST SO THAT WE CAN PURELY FOCUS ON SECURING THOSE APPROVALS WITHOUT WORRYING ABOUT COMING BACK HERE IF WE CUT ANY OF THOSE DEADLINES CLOSE.

AND SO WITH THAT, UH, WE CAN SWEAR IN MR. THON.

AND, UH, I HAVE A BACHELOR'S IN CIVIL ENGINEERING FROM OLD DOMINION UNIVERSITY WITH A MINOR IN ENGINEERING MANAGEMENT.

WE'VE ACTUALLY BEEN GOING BACK AND FORTH WITH, UH, THE PINELAND COMMISSION.

UH, BASICALLY A TIMELINE WAS WE SUBMITTED EVERYTHING OVER TO PINELANDS.

UH, THEY HAD SOME QUESTIONS, UH, IN REGARDS TO THE SEPTIC.

THERE WAS, ON THE ORIGINAL APPLICATION THERE WAS, UH, SOME DISCREPANCY CLERICALLY THAT STATED THAT THERE WAS PUBLIC WATER ON ONE OF THE, ON ONE OF THE PIECES OF, UH, THE APPLICATION AND EL ELSE IT DID SPECIFY THAT IT WAS SEPTIC AND THE PLANTS DID SHOW THE SEPTIC.

UM, YOU KNOW, THAT TOOK ABOUT TWO MONTHS AND THEY CAME BACK TO US AND SAID, YOU KNOW, PLEASE CLARIFY, WE CLARIFIED.

UM, THEY THEN PROCEEDED TO ASK FOR ADDITIONAL ENVIRONMENTAL ISSUES, YOU KNOW, DIFFERENT THINGS ON THE SITE.

UM, THEY JUST, YOU KNOW, CONTINUOUSLY, YOU KNOW, ASKED FOR A COUPLE DIFFERENT THINGS.

WE'VE BEEN GOING BACK AND FORTH AND MR. PHONE HAS BEEN, UH, WORKING WITH HIS LSRP TO CLEAR UP SOME OF THE ENVIRONMENTAL ISSUES.

SO THAT'S BEEN, YOU KNOW, SUBMITTED.

THEY PREVIOUSLY HAD SUBMITTED EVERYTHING.

UM, THIS WAS JUST, YOU KNOW, UPDATES.

AND, UH, YOU KNOW, AS OF MARCH, YOU KNOW, SOME ADDITIONAL PAPERWORK WAS SUBMITTED BACK TO THEM BY THE L-L-S-R-P.

WE'RE, UH, IN THE LETTER THAT WE RECEIVED TODAY, IT'S JUST STATING THAT THEY HAVEN'T RECEIVED ANYTHING FROM THEM ABOUT ANY ADDITIONAL REQUEST.

AND I

KNOW THEY'VE BEEN IN CONSTANT CONTACT WORKING WITH THEM TO, TO GET WHATEVER INFORMATION THEY NEEDED ON THE SITE.

SO JUST TO, JUST TO SUMMARIZE THAT TESTIMONY, UM, IT'S, WE'VE DONE EVERYTHING IN OUR POWER TO OBTAIN APPROVALS FROM THE PINELANDS.

THEY HAVE EVERY DOCUMENT THAT THEY REQUESTED OF US AND CURRENTLY DUE TO NO FALL OF OUR OWN, IT'S JUST SORT OF A WAITING GAME FROM THE PINELANDS TO HEAR BACK.

CORRECT? YES.

YEAH, EVERYTHING ELSE IS IN ORDER AND WAITING FOR, UH, RESUBMISSION BACK.

EVERYTHING'S BEEN ADDRESSED AS PER THE RRI LETTER AND, UM, WE'RE JUST WAITING ON THE, THE CLEARANCE ON THE PINES.

SO ORIGINALLY IT WAS THAT THIS WAS TWO DIFFERENT PROPERTIES, BUT THIS, YOU KNOW, THIS AREA HERE IS WHERE THE SEPTIC IS.

UM, THIS IS WHERE THE IMPROVEMENTS ARE GONNA BE TO THE GAS STATION.

SO THIS HAS, IT CURRENTLY HAS A SERVICE STATION AND IT CURRENTLY OPERATES AS A GAS STATION AND WE'LL BE CON CONVERTING THE CONVENIENCE STORE, I MEAN THE, UH, SERVICE STATION INTO A CONVENIENCE STORE.

UM, AND, AND YOU SAID THERE WAS PUBLIC WATER? NO.

SO THAT, THAT THERE WAS, UM, JUST SOME CONFUSION ON U UTILITY CONNECTIONS AND WHAT IT WOULD, THE QUESTION WAS FROM PINELAND WAS ABOUT THE PUBLIC, UH, SEWER.

OKAY.

YOU KNOW, THAT, THAT THESE PUBLIC SEWER WE HAD ON THE FORM ONE SPOT, I THINK IT WAS CHECKED, SAYING IT WAS PUBLIC, YOU KNOW, PUBLIC SEWER AND YOU KNOW, IT WAS SEPTIC AND OTHER, ANOTHER SPOT ON THERE.

IT DID CLEARLY STATE IT, IT WAS JUST, IT'S CONFUSION ON THEIR END, BUT IT TAKES SOME TIME ONCE IT GOES THROUGH THE PROCESS.

SO THAT'S WHY WE'RE, YOU KNOW, IN THE TIMELINE DELAY.

SO WE HAVE TO SEND THE SOIL SAMPLE AND WATER SAMPLE EVERY, EVERY, I THINK IT'S ONCE A YEAR, SO THAT IS ALREADY BEEN TAKEN CARE OF.

BUT THE HOLD UP IS WITH THE, WITH THE PINE COMMISSION.

SO THAT'S JUST WITH THE FUEL WHERE THE FUELS BEING IN THE GROUND THERE? YES.

IT'S NOTHING TO DO WITH THE SEPTIC OR IN THE BACK OR ANYTHING.

IT'S ALL FUEL STUFF? NO.

MOST OF THE CONTAMINATION IS COMPLETELY GONE.

IT'S, UH, AT THE LAST PART OF THE REMEDIATION.

NOW WE ARE ONLY DOING IT ONCE A YEAR.

UH, WATER SAMPLES AND, UH, NO MORE GROUND, UH, SOIL SAMPLES, BUT JUST THE WATER SAMPLES.

SO, SO HOW, LIKE ON, HOW, HOW DO YOU SAY IT? LIKE, I DON'T KNOW HOW TO SAY, IS IT CLEAR FROM ZERO TO A HUNDRED? LIKE WHERE ARE YOU? YEAH, SO, YOU KNOW, SO THIS IS A QUESTION THAT I'LL JUST POSE TO ADAM, JUST THAT I THINK ANSWERS YOUR QUESTION.

SO IN, I BELIEVE THE, THE PINELANDS OR THE, THE, THE MOST, NOT PINELAND SCRATCH THAT, THE MOST RECENT, UM, LETTER WE'VE RECEIVED FROM ENVIRONMENTAL PROFESSIONALS INDICATED THAT REME, THAT ANY REMEDIATION THE SITE NEEDED IS SUBSTANTIALLY COMPLETE.

AND I BELIEVE THAT LETTER SAID, UM, THERE WOULD BE ABSOLUTELY NO ISSUE BY 2028.

JUST NATURALLY IT JUST, THERE WAS, THEY FOUND JUST A HIGHER CONCENTRATION THAN, UM, NORMAL, JUST CERTAIN CHEMICALS, BUT NOT NECESSARILY FROM US, PREDATES US.

AND THAT BY 2028 IT SHOULD BE ABATED, BUT NO MORE REMEDIATION WITH DIGGING IT UP STUFF? NO, JUST ON THE NATURAL.
